A minimum order value of $99 (before taxes and discounts) is required to place an order through our Site, consistent with our Shipping Policy.

If your order is cancelled after payment, we will issue a full refund.

4.7 SMS marketing and cart reminders
By entering your phone number at checkout, on a sign‑up form, or otherwise opting in to SMS communications, you consent to receive recurring automated marketing text messages and cart reminders from ShopColdPlunge.com at the mobile number you provided.

Consent to receive SMS messages is not a condition of any purchase. Message and data rates may apply, and message frequency may vary based on your interactions (for example, browsing activity, cart status, and promotions).

You certify that the mobile number you provide is your own and that you have the authority to consent to receive text messages at that number. If you change or deactivate your phone number, you agree to update your account information and/or notify us promptly so that messages are not sent to someone else who may later receive your old number.

5. Shipping and delivery

5.1 Shipping policy
For detailed information about shipping times, procedures, and delivery issues, please refer to our Shipping Policy, which is incorporated into these Terms by reference. We currently ship within the contiguous United States only and do not ship to Alaska or Hawaii.

5.2 Shipping timeframes

Processing time: 1–3 business days
Delivery time: 3–9 business days (contiguous United States only)
Total delivery time = Processing time + Delivery time
Timeframes are estimates and not guaranteed

5.3 Shipping costs
Shipping costs are calculated at checkout based on your location and order details. Free shipping may be offered for qualifying orders as indicated on the Site. We do not offer shipping to Alaska or Hawaii at this time.

5.4 Risk of loss
Title and risk of loss pass to you upon delivery to the shipping carrier. We are not responsible for lost, stolen, or damaged packages once delivered to the carrier. For delivery issues, please see our Shipping Policy.

5.5 International shipping
We currently ship within the United States only. International shipping may be offered in the future; if so, the Site and policies will be updated accordingly.

6. Returns, refunds, and exchanges

For complete information about returns, refunds, and exchanges, please refer to our Return and Refund Policy. Key points include:

30‑day return window from delivery date
Defects must be reported within the time frame specified in our Return and Refund Policy
A restocking fee may apply for change‑of‑mind returns (for example, 25% where stated)
Return authorization (RMA) is required before sending items back
Items must be unused and in original packaging unless otherwise stated

7–13. IP, user content, prohibited use, and liability

Sections 7 through 13 (Intellectual Property Rights, User Content and Reviews, Prohibited Uses and Activities, Third‑Party Links and Services, Disclaimers and Warranties, Limitation of Liability, and Indemnification) remain as written in your original text, with no substantive changes.

14. Termination

We may terminate or suspend your access immediately for reasons including breach of these Terms, fraud, abuse, law‑enforcement request, or technical or security issues. You may terminate your account at any time by contacting Support@ShopColdPlunge.com.

Upon termination, your right to use the Services ceases, certain provisions survive, and outstanding orders will be processed per these Terms.

15–22. Governing law, disputes, privacy, force majeure, and feedback

Sections 15 through 22 (Governing Law and Jurisdiction, Dispute Resolution, Force Majeure, Privacy, Data Protection, and SMS Communications, Modifications to Terms, Miscellaneous Provisions, Specific Product Terms, and Feedback and Suggestions) remain the same as your original drafting, except that any email references are now updated to Support@ShopColdPlunge.com.

All notices related to disputes, arbitration opt‑outs, and other legal communications referenced in these sections should be sent to Support@ShopColdPlunge.com, in addition to any mailing‑address requirements already stated.

24. Acknowledgment and acceptance

BY USING OUR SERVICES, CREATING AN ACCOUNT, OR MAKING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS OF SERVICE, AGREE TO BE BOUND BY THEM, HAVE READ AND AGREE TO OUR PRIVACY POLICY AND RETURN AND REFUND POLICY, UNDERSTAND THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, ARE LEGALLY CAPABLE OF ENTERING INTO A BINDING CONTRACT, AND WILL USE THE SERVICES IN COMPLIANCE WITH APPLICABLE LAWS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY STOP USING OUR SERVICES.
